1. Acceptance of Terms

By accessing or using any website, platform, or service operated by Silvan Aubert (collectively “the Services”), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use.

2. Description of Services

Silvan Aubert provides digital architecture, strategic research, astrological report generation (NativeAstro.com), online directories, e‑commerce for physical goods, and related consulting. Specific terms for individual offerings may apply in addition to these general terms.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current, and complete information during registration.

4. Purchases, Pricing & Refunds

When you purchase a service or product:

  • Prices are displayed in Swiss Francs (CHF) and may be converted to your local currency at the prevailing rate.
  • Payments are processed through third‑party providers. I do not store full payment details.
  • Prepaid credits are promotional value, not stored cash. They cannot be exchanged for money and are non‑refundable.
  • Purchases are generally non‑refundable once a report is generated or a digital product is delivered. If you believe a technical error occurred, contact me within 48 hours for review.
  • If you provided incorrect birth data, you may regenerate the same report at a reduced rate within 24 hours.

EU/UK Right of Withdrawal

If you are a consumer residing in the European Union or the United Kingdom, you have a statutory right to withdraw from this contract within 14 days without giving any reason. For digital products (including astrological reports), this right expires if you explicitly consent to immediate delivery and acknowledge that you will lose your right of withdrawal once the product is delivered. By checking the consent box at checkout, you agree to immediate delivery and waive your withdrawal right accordingly.

Consent checkbox on checkout: “I agree that the digital product will be delivered immediately and I waive my 14‑day right of withdrawal.”

5. Birth Data & Generated Content

  • You retain ownership of the birth data you provide. By submitting it, you grant me a limited license to process it for the purpose of generating your reports.
  • The report text and designs are my intellectual property. You may download, save, and print your reports for personal use only.

6. Acceptable Use

You agree not to misuse the Services, including:

  • Attempting to interfere with the security or functionality of any site or platform.
  • Using automated tools to scrape, harvest, or bulk‑generate content without permission.
  • Uploading or transmitting any illegal, harmful, or abusive material.

7. Disclaimers

  • Astrological content is for educational, spiritual, and entertainment purposes only. It does not constitute professional advice of any kind, including medical, legal, financial, tax, or psychological advice. I am not a licensed financial advisor, therapist, or medical professional.
  • The Services are provided “as is.” I make no warranties about the accuracy, completeness, or reliability of any output.

8. Limitation of Liability

To the fullest extent permitted by law, Silvan Aubert shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. My total liability shall not exceed the amount you paid me in the twelve months preceding the claim.

9. Intellectual Property

All content, software, graphics, and branding on the Services are owned by Silvan Aubert or licensed to me. You may not reproduce, distribute, or create derivative works without prior written consent.

10. Third‑Party Links

The Services may link to external websites. I am not responsible for their content or practices.

11. Changes to These Terms

I may update these Terms from time to time. The latest version will be posted here. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law provisions. However, if you are a consumer residing in the European Union or the United Kingdom, you also retain the protection of the mandatory consumer protection laws of your country of residence. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Aargau, Switzerland, provided that consumers may also bring proceedings in their country of residence in accordance with applicable law.
